Expectations for a Court Martial Trial

Although the term is quite familiar to military personnel, there are many things to know before a court martial trial. Because the trial is a military proceeding, not federal, the rules for procedure and evidence are not the same as typical hearings. The procedure is dictated by the Manual for Courts-Martial, and the evidence is determined by the Military Rules of Evidence. The trial will be adversarial in nature, meaning that there will be a prosecution and a defense. Either side is determined to convince the judge that their side of the issue is correct. Army lawyers will each present the facts, legal aspects and arguments to support their side. The judge in the case will be a military figure as will the jury or court panel, if necessary.

When to Use Army Lawyers

For extremely straight forward cases or ones with minor consequences, formal legal representation may not be necessary. In most situations though, the accused will want to have Army lawyers who they know they can trust. In some situations an appointed military attorney will be available to assist with legal matters. Although this service is convenient, it is not always the most useful option available. Soldiers are able to hire their own personal military defense. Fayetteville, North Carolina based law firm, Gorecki & O'Callahan specialize in court martial cases.
